Quite predictably, pending home sales have declined precipitously due to the lack of available inventory.
Lenders have a variety of reasons for withholding inventory right now, but among the biggest reasons is their desire to cause house prices to bottom. Lenders make the false assumption that supply and demand controls all pricing. It does not. Withholding supply may help buoy prices in the short term, but affordability puts a cap on prices stopping them from rising.
Lenders hope active buyers raise their bids and push prices higher. After all, that’s what buyers did during most of the housing bubble. Buyers have some ability to raise their bids by substituting to inferior housing stock, and some buyers do raise their bids only to be knocked down by an appraiser rooted in reality. Unfortunately for lenders, buyers are limited in what they can borrow by prudent lending standards. Fearful of a forced buyback on a GSE or FHA loan, the originating lender aggressively verifies income and strictly limits the borrower to conforming loan standards. This prevents prospective buyers from raising their bids irrespective on any limitations of supply. In other words, lenders can restrict supply all they want, it isn’t going to make buyers bid any higher and close the deal.
So what is the end result of restricted supply and effective limits on potential buyer’s borrowing power? A plethora of canceled escrows and a dramatic drop in completed home sales. 
California pending home sales down (remaining headline CAr bullshit)
LOS ANGELES (May 22) – After posting a strong performance in March, California pending home sales slipped in April, but were higher than a year earlier for the twelfth consecutive month, the CALIFORNIA ASSOCIATION OF REALTORS® (C.A.R.) reported today. Additionally, the share of equity sales posted its highest level in nearly four years.
Those pesky CAr banana peels strike again. Apparently, the bullshit artists at CAr decided the word “slipped” sounds innocuous and won’t alarm anyone to the fact that sales went DOWN. A slip is a temporary setback of little consequence, or at least that’s what CAr wants prospective buyers to think. Perhaps this is a “slip,” but sales very rarely “slip” between April and May. Spring is the beginning of the prime selling season, and sales almost always go up each month from March through August. A sharp decline, and this was a sharp decline, is not a positive sign.
Pending home sales:
C.A.R.’s Pending Home Sales Index (PHSI)* declined from a revised 138.9 in March to 128.0 in April, based on signed contracts. The index was up from the revised 114.4 index recorded in April 2011, marking the twelfth consecutive month that pending sales were higher than the previous year. Pending home sales are forward-looking indicators of future home sales activity, providing information on the future direction of the market.
By CAr’s own admission, a declining pending home sales index means the housing market is weakening and should be heading down soon. The spring rally is going to fizzle out just like it did last year.
“Inventory constraints could be a contributing factor to lower pending sales,” said C.A.R. President LeFrancis Arnold. “The tight inventory we’ve been experiencing in the distressed market over the past several months is now spreading to equity properties, essentially affecting the supply conditions of both the distressed and non-distressed markets.”
Does anything this guy said make any sense? How does tight inventory spread to equity properties? There are plenty of equity properties on the market. Most of them are ridiculously overpriced rendering them unsalable, but they are on the market. Further, there is no distinction between the distressed and non-distressed market.
There is only one real estate market. It is composed of reasonably priced REOs and short sales and WTF priced discretionary sellers. The REOs and short sales sell while the WTF priced properties do not. These are not separate markets. Both properties coexist in the same market, although based on what some discretionary seller ask for their properties, an argument can be made that they live in an alternate reality.
Sales dropped nationally too
California was not the only market to experience pain. All the western states where banks are withholding inventory saw sharp declines in sales.
Existing home sales decline in March (remaining headline NAr bullshit)
WASHINGTON (April 19, 2012) – Existing-home sales were down in March but continue to outpace year-ago levels, while inventory tightened and home prices are showing further signs of stabilizing, according to the National Association of realtors®.
Notice how the NAr dresses up the negative truth with bullshit positive spin?
Total existing-home sales1, which are completed transactions that include single-family homes, townhomes, condominiums and co-ops, declined 2.6 percent to a seasonally adjusted annual rate of 4.48 million in March ….
Sales don’t decline at this time of year unless something is terribly wrong with the market. The spring rally in 2011 also fizzled out in May due to the market headwinds that still exist today.
Lawrence Yun, NAR chief economist, said the recovery is in the process of settling into a higher level of home sales. “The recovery is happening though not at a breakout pace, but we have seen nine consecutive months of year-over-year sales increases,” he said.
When coming off one of the slowest sales years ever recorded, it shouldn’t be surprising sales are up over last year. Yun makes this out to be a big deal when it’s really not.
“Existing-home sales are moving up and down in a fairly narrow range that is well above the level of activity during the first half of last year.
This is the prime selling season. Sales should be moving up briskly as compared to the first months of the year. The fact that they are not is ominous.
With job growth, low interest rates, bargain home prices and an improving economy, the pent-up demand is coming to market and we expect housing to be notably better this year.”
The old “pent-up demand” bullshit. Desire is not demand. The NAr always expects housing to be notably better. Any improvement will be touted as a great comeback, and if the market disappoints (which it may), then it will be written off as some unexpected anomaly rather than a direct result of the obvious problems overhanging the market.

The housing recovery momentum continues? When Lawrence Yun tells a real whopper, I wonder if he feels any regret. He and other at the NAr have induced millions of buyers into committing financial suicide since 2006 so they could line their own pockets. There is a special place prepared for his ilk.
The banks are only hurting themselves by delaying liquidation, but in their world, it really doesn’t matter. They win either way.
Replacing the Ponzis
Plenty of prospective buyers are interested in obtaining a free ATM machine, but since those most likely to spend this free money imploded, there is insufficient demand from those with good credit to absorb the inventory. Even if we wouldn’t have had a price crash, the move-up market would be weak because the Ponzis spent all their move-up equity. The result of all this Ponzi borrowing is properties like this one pillaged by their former owners need to be liquidated. Lenders have many more homes like this than they have new buyers to absorb them, so they withhold this inventory from the MLS hoping at some point in the future, a buyer will materialize.
- The former owners of today’s featured property were typical OC Ponzis. They paid $575,000 on 9/4/2003 using a $431,000 first mortgage and a $144,000 down payment.
- They refinanced with a $460,000 first mortgage on 4/15/2004.
- On 9/22/2004 they obtained a $87,500 HELOC.
- On 1/31/2006 they refinanced with a $537,000 first mortgage.
- On 7/3/2006 they obtained a $250,000 HELOC.
It’s difficult to tell how much of the HELOC they used, but the bank took the property back on 2/2/2012 for $676,471, so the first mortgage increased by about $140,000 since 2006. Either these people squatted for a long time and the fees and missed payments really added up, or some part of the HELOC was used. Either way, these people lost everything, including the $144,000 down payment they put into the property.

Notice how home values in Huntington Beach are in a slow decline. I thought the home market was back with 3.75% mortgage rates? Maybe we need 2.75%? I heard Uncle Ben is working on that.
Yep. I suspect mortgage interest rates will keep declining until the market does really bottom. Lenders don’t want to lower the price, so they are lowering the cost of ownership instead.
There is a lot going on behind the curtain in the world of ‘paper’ markets (aka land of unicorns and fairy-dust)…..
To a certain extent, banks can simply trade interest rate swaps to effectively raise or lower rates; ie., short selling IRswaps can make rates fall, thus, prices rise.

You make it sound so easy – it’s not. You need to find some other sucker to take the other side of the bet – not so easy now I would presume unless they are packaged into some exotic instrument with less visibility.
Indeed, not so easy now…. as time passes, the element of trust continues to fade between counterparties. Once gone, it truely will be game over.
Well, the best way is we all should not bid up any price. If someone want to pay higher price, let them have it.
That’s exactly what most readers of this blog are doing. There is far too much shadow inventory to believe all the good deals are gone forever.
More evidence of banks shifting from foreclosures to short sales
Short Sales Processed Quicker in First Quarter
With new deadline requirements set by the Federal Housing Finance Agency (FHFA) looming on the horizon, short sales are expected to increase after an already active first quarter.
According to RealtyTrac’s Q1 2012 U.S. Foreclosure Sales Report, pre-foreclosure sales (most often short sales) reached their highest level in the first quarter of 2012 than they’ve seen since 2009. The report went on to show that pre-foreclosure sales accounted for 12 percent of all sales during the first quarter of 2012, up from 10 percent in Q4 2011 and 9 percent in Q1 2011. Third parties purchased a total of 109,521 pre-foreclosure homes in the quarter, an increase of 16 percent from the previous quarter and 25 percent year-over-year.
Pre-foreclosure homes that sold in 2012’s first quarter took an average of 306 days to sell after starting the foreclosure process, a decrease from 308 days in the previous quarter but up from 256 days in the first quarter of 2011. The FHFA issued guidelines in April that will require servicers to make a decision within 30-60 days of receiving an offer on a property under a short sale program. The new deadline requirements, which go into effect June 15, comes as a welcome change to buyers and sellers who felt that servicers were taking too long to complete sales.
The report also showed that pre-foreclosure sales prices have been falling. In first-quarter 2012, the average sales price of a pre-foreclosure home was $175,461, down 4 percent from the previous quarter and 10 percent from first-quarter 2011. This price was the lowest quarterly average price in the history of the report, which goes back to the first quarter of 2005. It was also 21 percent below the average price of a non-foreclosure home, up from a 19 percent discount in Q4 2011 and a 16 percent discount in Q1 2011.
“Foreclosure-related sales picked up in the first quarter, particularly pre-foreclosure sales where a distressed homeowner is selling to avoid foreclosure—typically via short sale,” said RealtyTrac CEO Brandon Moore. “These pre-foreclosure sales hit a three-year high in the first quarter even as the average pre-foreclosure sales price dropped to a record low for our report. Lenders are approving more aggressively priced short sales, which in turn is resulting in more successful short sale transactions.”
Apparently, realtor bullshit about being priced out forever is not flying with today’s homebuyers.
Survey: Buyers Frustrated by Low Inventory, Rising Prices
Active home buyers are increasingly concerned about rising prices, prompting a growing number to slow down their purchase plans, according to a new survey.
The findings are from real-estate brokerage Redfin, which surveyed more than 1,200 home buyers in 18 metro areas who had toured a home since March 1.
The company found that 49% of respondents believe that it’s a good time to buy a home, down from 56% last quarter. The share of buyers who think it’s a good time to sell more than doubled, to 28% of respondents.
Nearly six in 10 respondents said that low inventory remained their top concern with buying right now—by far the most predominant worry of buyers. The supply of homes listed for sale nationally is down by 20% from one year ago, and markets such as Phoenix, Orlando and Oakland, Calif., have around half as many homes for sale as one year ago.
More than seven in 10 buyers said they had faced a competing offer when making an offer for a home.
Given those experiences, perhaps it isn’t surprising that 58% of buyers said they think prices will increase, up from 34% last quarter. Meanwhile, just 9% of buyers said that concerns about falling prices were making them reluctant to buy right now, down from 29% three months ago.
The lack of supply and the uptick in multiple offer situations is surprising to many buyers and could lead some frustrated buyers to stand back. More than one-quarter of buyers said they would stand back from the market if prices went up or they were in a multiple-offer situation, while 10% of respondents said they’d do what it takes to win a competitive bid.
Meanwhile, just 9% of buyers said that concerns about falling prices were making them reluctant to buy right now, down from 29% three months ago.
I guess people really do have a hard time understand the principal of leverage and affects of interest rates on leveraging. Right now I’m trying to deleverage.
This would be a concern if low inventory was here to stay indefintely. Something tells me that won’t be happening.

Once Mr Market decides to punish banker hubris (always does) banks will lose control and rates will finally rise. This sustained repricing event will force banks to offload their toxic paper/REO stat! Hedge funds too.
Responding to el ORACLE (above)…if rising rates cause prices to drop, won’t that lead to even more underwater borrowers…and being underwater is the greatest risk factor associated with stopping payment….so if rates rise we would be in for a new cycle of drops…

Yes. Continued price declines or rising interest rates will trigger another wave of strategic defaults or strategic short sales which in turn will create more squatters or lower prices (or both).
Are there studies done to show the tipping point for strategic defaults. For instance, at at a 10% underwater amount a high percentage start doing a strategic default, or does it take 20% underwater? Seems like there would be a threshold where it becomes problematic – just not sure what that is.
The default rate rises dramatically at the water line. It increases exponentially as you go further and further underwater. Cascading strategic default is one of the biggest motivators the banks have in propping up prices.

Second, borrowers with negative equity are more likely to default on their mortgages. Both theoretical research, such as Campbell and Cocco (2011), and empirical research, such as Bhutta, Dokko, and Shan (2010), show that mortgage default rates increase significantly when borrowers become deeply underwater.
Given that there are 3 million first-lien mortgages that have LTVs of 125% or above as of April 2012, whether or not a large fraction of these mortgages will default in the near future has important implications for the housing market recovery.
There is no indication whatsoever that interest rates will be rising anytime soon. Welcome to the U.S. of Japan.
